<p>These Terms &amp; Conditions apply to your use of seadoocanam.com.au and to any order you place through it. The website is operated by Beaches Sea-Doo &amp; Can-Am ("Beaches", "we", "us" or "our"), 770 Pittwater Road, Brookvale NSW 2100.</p>

<p>By using our website or placing an order, you agree to these terms. Please also read our <a href="/shipping-returns/">Shipping &amp; Returns</a> policy and <a href="/privacy-policy/">Privacy Policy</a>, which form part of these terms.</p>

<p>Nothing in these terms limits or excludes your rights under the Australian Consumer Law (ACL) or any other law that cannot be excluded.</p>

<h2>Using our website</h2>

<p>You agree to use our website only for lawful purposes. You must not misuse it, including by trying to gain unauthorised access, interfering with how it works, or posting content that is false, misleading, offensive or unlawful.</p>

<p>If you create an account, you are responsible for keeping your login details private and for activity on your account. Please let us know straight away if you think someone else has used it.</p>

<p>If you submit a product review or other content, it must be honest and lawful. You allow us to display, edit for length or formatting, and remove it on our website. We may decline or remove content at our discretion.</p>

<h2>Prices and GST</h2>

<p>All prices are in Australian dollars (AUD) and include GST unless stated otherwise. Shipping charges are not included in product prices and are shown at checkout before you pay.</p>

<p>For orders delivered outside Australia, the destination country may charge import duties, taxes or fees. These are not included in our prices and are the responsibility of the person receiving the order.</p>

<p>We may change prices at any time, but changes won't affect orders we have already accepted.</p>

<h2>Product availability and errors</h2>

<p>We try to keep stock levels, descriptions, prices and images on our website accurate and up to date. However, products may sell out, and errors can occasionally happen.</p>

<p>If a product you order is unavailable, or there is an obvious error in the price or description, we will contact you. You can then choose to go ahead at the correct price or with an alternative (if one is available), or cancel the order for a full refund of anything you have paid.</p>

<p>Product images are for illustration only. Colours, packaging and minor details may differ from what you see on screen.</p>

<h2>Orders and acceptance</h2>

<p>When you place an order, you are making an offer to buy the products. You will receive an email confirming that we have received your order &#8211; this is not acceptance of your order.</p>

<p>Your order is accepted when we dispatch the products (or confirm your order is ready for collection, if that option is offered). Beaches reserves the right to accept or decline any order at any time, for example where a product is unavailable, there is a pricing error, we suspect fraud, or we can't ship a product to your address. If we decline an order after you have paid, we will refund you in full.</p>

<h2>Payment</h2>

<p>Payment must be made in full at checkout using one of the payment methods shown, which may include Visa, Mastercard, American Express, PayPal and Apple Pay. Payments are processed securely by our payment providers. We do not store your full card details.</p>

<p>If you choose a PayPal option such as Pay in 4, that arrangement is between you and PayPal and PayPal's terms apply.</p>

<p>We may carry out checks to help prevent fraud and may cancel an order if payment cannot be verified.</p>

<h2>Shipping and delivery</h2>

<p>Shipping is covered in our <a href="/shipping-returns/">Shipping &amp; Returns</a> policy. In summary:</p>

  <li>Shipping rates for many of our products are weight-based. The weight of each item is shown on its product page, and weights are rounded up to the next full kilogram to reflect the policies of the shipping companies we use.</li>
  <li>Shipping costs are calculated and shown at checkout.</li>
  <li>When you place an order, we will estimate shipping and delivery dates based on the availability of your items and the shipping options available. These are estimates only.</li>
  <li>Some products have shipping restrictions and some cannot be shipped to international destinations.</li>
</ul>

<p>Please make sure your delivery address is correct. Ownership and risk in the products pass to you on delivery.</p>

<h2>Returns and refunds</h2>

<p>Our returns rules are set out in our <a href="/shipping-returns/">Shipping &amp; Returns</a> policy. In summary:</p>

  <li><strong>Change of mind returns and exchanges are not available.</strong> This includes products ordered by mistake or parts that don't fit because the wrong item was ordered.</li>
  <li><strong>Faulty products:</strong> under the Australian Consumer Law, if something is faulty we will provide an exchange, repair or refund, provided the item is returned within a reasonable time.</li>
  <li>You must provide proof of purchase to make a claim. We may decline a refund or repair where a fault is caused by misuse or neglect.</li>
  <li>To start a return, please <a href="/contact-us/">Contact Us</a> with your order number and details of the product. We'll reply with instructions.</li>
  <li>Once the item has been received and reviewed, we will process any refund and let you know by email. Refunds are usually credited within 5&#8211;7 working days, depending on the payment method you used.</li>
</ul>

<p>Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.</p>

<h2>Product information and parts fitment</h2>

<p>Product descriptions and specifications are based on information from manufacturers and suppliers.</p>

<p>Before ordering parts or accessories, please check that they are compatible with your vehicle or watercraft &#8211; including make, model, model year and part number. If you are not sure, contact us before you order and our team will be happy to help. Because change of mind returns are not available, it's important to confirm fitment first.</p>

<p>Where a product needs to be installed, we recommend it is fitted by a qualified technician. Damage or faults caused by incorrect installation, misuse or neglect may not be covered.</p>

<h2>Warranty</h2>

<p>Your rights under the Australian Consumer Law apply to everything you buy from us (see "Returns and refunds" above).</p>

<p>Some products also come with a manufacturer's warranty. Any manufacturer's warranty is provided by the manufacturer on its own terms, which may be included with the product or available from the manufacturer. A manufacturer's warranty is in addition to, and does not replace, your rights under the Australian Consumer Law. If you need help with a warranty claim, please contact us.</p>

<h2>Our liability</h2>

<p>Nothing in these terms excludes, restricts or changes any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.</p>

<p>To the extent permitted by law:</p>

  <li>we are not liable for any indirect or consequential loss (such as loss of profit, loss of use or downtime) arising from your use of our website or products, other than loss that was reasonably foreseeable as a result of our failure to meet a consumer guarantee; and</li>
  <li>where the goods are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to (at our option) replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.</li>

<h2>Intellectual property</h2>

<p>The content on our website, including text, images, graphics, logos and layout, is owned by or licensed to us and is protected by law. You may view and print pages for your personal use, but you must not copy, reproduce or use our content for commercial purposes without our written permission.</p>

<p>Sea-Doo, Can-Am and other brand names and logos shown on our website are trademarks of their respective owners.</p>

<h2>Links to other websites</h2>

<p>Our website may link to other websites, such as social media pages or manufacturer sites. We are not responsible for the content or practices of those websites.</p>

<h2>Changes to these terms</h2>

<p>We may update these terms from time to time. The version on this page at the time you place your order applies to that order.</p>

<h2>Governing law</h2>

<p>These terms are governed by the laws of New South Wales, Australia. You and we agree to the non-exclusive jurisdiction of the courts of New South Wales.</p>
